These ASICS Official Tokyo Marathon Merchandise Terms of Sale (these“Terms of Sale”) only apply to the purchase of ASICS Official Tokyo Marathon Merchandise products offered for sale on this website (“Products”).

PLEASE REVIEW THESE TERMS OF SALE CAREFULLY PRIOR TO ORDERING PRODUCTS ONLINE AS THEY AFFECT YOUR LEGAL RIGHT. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OR IF YOU DO NOT HAVE THE LEGAL CAPACITY TO ENTER INTO THESE TERMS OF SALE (I.E.,IF YOU ARE NOT OF SUFFICIENT AGE, MENTAL CAPACITY OR ARE OTHERWISE ENTITLED TO BE LEGALLY BOUND IN CONTRACT), YOU MUST NOT PURCHASE PRODUCTS.

In these Terms of Sale, the use of “ASICS” (or “we”, “us”, or “our”, as the case may be) refers to ASICS Japan Corporation, incorporated under the laws of Japan, with its principal offices at JP TOWER, 7-2, Marunouchi 2-chome, Chiyoda-ku, Tokyo, 100-7024.

These Terms of Sale may be amended from time to time by posting the amended terms on this website (this “Site”) in advance, specifying the effective date of the amendment. By making an online purchase following the posting by us of any version of these Terms of Sale, you are deemed to have agreed to the then current Terms off Sale.

Please note that it is your responsibility to ensure that your equipment (computer, laptop, netbook, tablet or other mobile device) is compatible with this Site and meets all the necessary technical specifications to enable you to access and use this Site.

To purchase a Product, please select a Product by placing it in the shopping cart, proceeding to the checkout page and providing all required information including correct name and address, phone number, e-mail address, payment details and other required information.

You should carefully review the order summary to ensure all information provided is correct and correct any errors prior to submitting your order ("Order"). Your Order constitutes an offer by you to ASICS to purchase the selected Product. All Orders are subject to acceptance by ASICS email confirming that your Order has been accepted.

Upon completing your first Order on this Site, your account will be automatically created.

Prices appearing on this Site are in Japanese yen and are inclusive of consumption tax.

You will be solely liable for all credit card charges, including bank charges on the transaction for each online purchase.

We only accept Visa, Mastercard, American Express, JCB, as methods of payment for purchase of Products on this Site.

(a)All purchased Products must be collected at ASICS stand in the 2026 Tokyo Marathon Expo (Location:Tokyo Big Sight South Exhibition Hall 4F, Ariake 3-11-1, Koto-City, Tokyo) (“ASICS Stand”)from Feb 26th to 28th 2026. Please note that no product delivery services are available.

(b) Should you fail to collect the purchased Products by Feb 28th 2026 from ASICS Stand, the sales agreement shall be automatically terminated by ASICS without any notice. In this case, ASICS shall have the right to claim damages from you in an amount equivalent to the purchase price. ASICS may offset the obligation to return the purchase price to you against the claim for damages in an equivalent amount without any notice, effective from March 1st 2026 or onward. Any purchased Products not collected from ASICS Stand will be returned to ASICS.

(c) Title and risk of loss for Products purchased on this Site pass to you upon your collection at ASICS Stand.

Products are not eligible for return or refund, unless they are faulty. By purchasing a Product, you agree that the item cannot be returned or refunded unless faulty.

The Products sold on this Site are provided solely for the personal use and benefit of end user consumers and any purchase of Product for resale is strictly prohibited.

All intellectual property rights in the Products supplied to you are retained by ASICS or its parent company and you are not entitled to reverse engineer or rebrand the Product in any way.

ASICS warrants to you that purchased Products will be free from manufacturing defects for of collection at ASICS Stand.This limited warranty does not extend to any subsequent owner or consumer or any other transferee of the Product. This limited warranty does not cover any defects due to improper fit, normal wear and tear, damage due to improper use, misuse or abnormal usage, improper transportation or storage, natural degradation of colors or materials, failure to follow product instructions, modification or alteration to the Product, unauthorized repair, or negligence.

The terms provided in the Limited Warranty and the remedies set forth therein are exclusive and in lieu of all others, whether oral or written, expressed, implied, or statutory. ASICS PROVIDES ACCESS TO THIS SITE “AS IS”, "WITH ALL FAULTS", AND “AS AVAILABLE”, WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS ON ALL USES AND/OR PURCHASES. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW AND EXCEPT AS EXPRESSLY SET FORTH HEREIN, ALL SUCH REPRESENTATIONS AND WARRANTIES ARE

HEREBY EXPRESSLY DISCLAIMED. WITHOUT LIMITING THE FOREGOING, EXCEPT AS EXPRESSLY SET FORTH HEREIN, ASICS DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, FOR ANY PRODUCT. ASICS FURTHER DISCLAIMS ANY WARRANTIES EXPRESS OR IMPLIED AS TO THE ACCURACY OR COMPLETENESS OF EACH PRODUCT INCLUDING, WITHOUT LIMITATION, PRICING, QUANTITY AND SIZING. ASICS DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION POSTED AT THIS SITE IS ACCURATE, COMPLETE, OR CURRENT OR THAT DIGITAL STORES WILL OPERATE WITHOUT INTERRUPTION, WITHOUT ERROR OR WITHOUT DEFECTS, BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS. THE FOREGOING DISCLAIMERS OF WARRANTY ARE ENFORCEABLE TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW.

ASICS’ liability for any loss or damage (however caused) in relation to the supply of Products to you is limited to those caused due to reasons attributable to ASICS, and is limited to the purchase price of the Product(s) you purchased in connection with the claim unless the damage was caused by ASICS’ willful misconduct or gross negligence.

To the fullest extent permissible by applicable law, you agree to indemnify, defend and hold harmless ASICS, its officers, directors, employees, agents, distributors. subsidiaries, parents and affiliates, licensors and suppliers from and against any and all claims, demands, losses, liabilities, costs or expenses, including, without limitation, reasonable attorney’s fees, which arise directly or indirectly out of or from your conduct in connection with this Site or any violation of these Terms of Sale, any law, or the rights of any third part

ASICS reserves the right to terminate any Order upon notice before collection of the purchased Product(s). ASICS will promptly refund you the purchase price of the purchased Product(s) if ASICS terminates your Order.

No waiver of any right, remedy or obligation by a party will be effective unless in writing and executed by that party. If, for any reason, a court of competent jurisdiction finds any provision of these Terms of Sale, or any portion thereof, to be invalid or unenforceable, that provision or portion is to be read down or severed to the extent of the invalidity or unenforceability for that jurisdiction, and the remainder of these Terms of Sale will remain in full force and effect. These Terms of Sale are governed by and construed in accordance with the laws of Japan, without reference to its conflicts of law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. Each party irrevocably submits to the non-exclusive jurisdiction of Tokyo District Court, Japan and any courts of appeal from them for determining any dispute concerning these Terms of Sale.
